Apple vs Samsung: Galaxy Blocked in The USA? After the Australia where things might well turn to Samsung, it’s in the United States that Apple just see its appeal rejected by the Court of the district of California: there is no blocking sales of the products for the Galaxy, including among other the Galaxy Tab 10.1 Tablet and smartphone Galaxy S2 in the United States.
Unlike the German, Dutch or Australian justices, the United States will not preliminary injunction against Samsung products targeted by a complaint from Apple for patent infringement apply: Judge Lucy Koh, who operates the Tribunal to the Court for the district of California announced it this weekend.
This decision does however not call into question the future trial which will oppose the two companies next year, but allows Samsung to continue to sell its products during the crucial period of the holiday of the year: according to the South Korean company, it was the strategic issue of the request for blocking. “This decision confirms as we say it has long been that Apple arguments lack merit,” Samsung said in a statement.
This is the second time Samsung wins a battle against Apple: Australian Court recently announced the preliminary injunction blocking the sale of the Galaxy Tab 10.1 in the country. An announcement however slowed by Apple which, using, has delayed the procedure for a week.
